The Not So Fun, But Important Stuff
FEES AND CANCELLATIONS
Client Shall Pay the Total Cost to Provider as follows:

The first payment is a Non-Refundable Retainer. At a minimum, the Client agrees that the retainer fee fairly compensates the Provider for committing to provide the Services, which includes resourcing products, vendor communication, initial payments to 3rd party vendors, administration duties prior to the wedding and turning down other potential projects/clients.

Payment of Balance is due 1 month prior to the Wedding Date. If the balance is not made by the Balance Due Date, outstanding details will not be finalized and no further work will be undertaken and the contract may be immediately terminated by Pop Up Weddings YEG with no payments refunded. If Pop Up Weddings YEG, in its sole discretion, determines the contract can still be fulfilled after the Balance Due Date, and the client wishes to continue the contract, there will be a 10% fee added to the balance. In addition, any costs incurred as a result of the late payment will be passed on to the client. If the client has provided a credit card for payments, future payments CAN be automatically processed on their respective due dates. Alternatively, any payments may be made by cash, certified cheque, Visa, MasterCard or e-Transfer.

Cancellations & COVID19:

Cancellation Policy. Any cancellations made more than 30 days prior to the Wedding Date will forfeit the Initial Non Refundable Retainer Deposit. Any additional funds paid will be refunded, less costs already incurred in relation to the work already completed and deposits made in the securing of Services by 3rd party vendors. Cancellations made less than 30 days prior to the Wedding Date will result in forfeiture of ALL payments made and NO refund will be issued.

Cancellation by Pop Up Weddings YEG Due to Unforeseen Circumstances (including but not limited to fire, natural disaster, tragedy or other emergency) and are unable to perform the services, all monies paid by the client will be refunded and Pop Up Weddings YEG’s liability for any costs will under no circumstances exceed the total amount paid by the client.

COVID19

Cancellations due to COVID19 Should the planning and execution of a wedding be disrupted due to the following reasons related to COVID19 then Pop Up Weddings YEG will work with the couple to postpone their wedding and transfer all monies paid other than monies paid for perishable items like food or flowers that have already been purchased to a new date within a 12 month period. New date must be mutually agreed upon by both provider, client and 3rd party vendors where a non refundable deposit has been made. Note due to price changes for product or services at the time of the new date additional fees may be required to provide the same quality of service as initially agreed upon.

Either partner become ill or are required to quarantine due to exposure to someone with COVID 19

Venue closes or is unable to provide the service required due to COVID 19 related issues and we can't find a substitution on time.

Provincial health authorities announce new regulations that make hosting a wedding ceremony impossible.

The client agrees that planning a wedding during a global pandemic holds some risk and understands that the situations and regulations are constantly changing and by choosing to plan a wedding during a pandemic accepts those risks. If client(s) decide to cancel their wedding then the previously stated cancellation policy will apply.

Pop Up Weddings YEG will do its very best to know and understand the most current regulations and will work with the couple to provide services that follow the regulations.

Client(s) further understand that Pop Up Weddings YEG and its affiliated vendors (L'Atelier Design) will comply with all health and safety laws, directives, rules and provincial regulations. The Provider will advise all 3rd party vendors secured by us of our protocol expectations, however we will not be held responsible if the protocols are not adhered to.

The client expressly agree that during the wedding, Client(s), their family and guests’ shall adhere to guidelines in regards to current AHS regulations such as but not limited to masking, allowable number of attendees, social distancing and guidelines in regards to food service and acceptable reception activities ie. dancing, receiving line etc.

The Client(s) will not request the [Provider] to do anything illegal or unsafe. Further, [Provider] will not provide services in any location or under circumstances deemed to be unsafe in its sole discretion, including, but not limited to, client(s), bridal party, family and or guests not following AHS COVID protocol regulations. Under any of these circumstances, [Provider] reserves the right to end service coverage immediately and/or leave the wedding. [Provider] shall be entitled to retain all monies paid and Client(s) agree to relieve and hold [Provider] harmless as a result of incomplete event coverage, or for a lapse in the quality of the [Provider’s] work.

CHANGES TO SERVICES

The client is responsible for notifying Pop Up Weddings YEG of any significant changes to the overall design (including but not limited to: guest count, changes of colour palette, venue, floral components, décor or services required) a minimum of 1 month prior to the wedding date. Any significant changes requested after this date, will result in the client being billed for:

Additional product, material or labour costs incurred to accommodate the new design.

Product, material or labour costs incurred by us in executing the original design.

At the time of the initial deposit, adjustments can be made to the invoice for the Uniquely Yours Package. Additions and subtractions are accepted up until 1 month prior to the wedding date, when the balance is paid in full; however planning services is non negotiable and cannot be reduced. Once materials or rentals have been ordered, the services fees can no longer be decreased.

Additions less than 1 month prior to the Wedding Date must be paid for within 24 hours of confirmation of the change. Pop Up Weddings YEG does not guarantee that the flowers previously ordered will be available nor does Pop Up Weddings YEG guarantee any pricing that may have previously been quoted or attained. Colour and style will be matched as closely as possible.

Pop Up Weddings YEG will do everything possible to avoid floral, product or service provider substitutions; however, circumstances may arise that might require alternate selections to be made for the materials or service providers. Where Pop Up Weddings YEG determines it necessary, it may substitute flowers, products, materials or service providers of equal or greater value to those previously agreed upon. The clients will be notified in advance if a substitution is required. Pop Up Weddings YEG not be liable for staining of any garments or other items due to the usage of dyed flowers.

The client will provide confirmation 1 month prior to the Wedding Date for all details regarding the services and any amendments that have been made.

EXCLUSIVITY

The Client understands and agrees that they have hired the Provider exclusive of any other Planning or Floral service provider Sweet & Simple & Love Forever Package.. In order to provide a high level of satisfaction and quality of service, no other planning or floral service providers, other than any assistant or third party that the Provider hires to complete the Services outlined in the Agreement, are permitted to provide the same or similar services or products, paid or unpaid, at the locations and dates specified in the Agreement.

ARTISTIC RELEASE
Style

The Client has spent a satisfactory amount of time reviewing the Provider's work and has a reasonable expectation that the Provider will perform the Services in a similar manner and style unless otherwise specified in the Agreement.
Consistency

Pop Up Weddings YEG will use reasonable efforts to ensure the Client's desired Services are produced in a style and manner consistent with the Provider current portfolio and the Provider will try to incorporate any reasonable suggestion made by the Client. However, the Client understands and agrees that:

Every client and wedding is different, with different tastes, budgets, and needs;

services are often a subjective art and Pop Up Weddings YEG has a unique vision, with an ever-evolving style and technique;
-

Pop Up Weddings YEG will use its artistic judgment when providing Services for the Client, which may not include strict adherence to the Client’s suggestions;
-
Although Pop Up Weddings YEG will use reasonable efforts to incorporate the Client’s suggestions and desires when providing the Client with the Services, Pop Up Weddings YEG shall have final say regarding the aesthetic judgment and artistic quality of the Services;
-
Dissatisfaction with Pop Up Weddings YEG's aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

RENTALS AND OTHER ITEMS USED

All items rented from Pop Up Weddings YEG, or a third party provider through Pop Up Weddings YEG must be treated with care and concern during the wedding. If rental items are damaged or missing at the end of the wedding, the client will be charged for the full replacement cost within 5 business days.

Décor or other items not provided by Pop Up Weddings YEG but used on the Wedding Date are not guaranteed by Pop Up Weddings YEG, even in cases where those items are integrated with components and items provided by Pop Up Weddings YEG. Alterations to components and items provided by Pop Up Weddings YEG to accommodate other décor will be made at Pop Up Weddings YEG’s discretion to maintain the integrity of the proposed design.

VENUE AND ACTIVITIES

Activities on the Wedding Day are limited by the rules and guidelines of the location where the Wedding will be held. It is the responsibility of the client to ensure that all activities are permitted at the venue. Negotiation with the venue owner or manager to permit any activity otherwise not permitted at the venue is the sole responsibility of client; Pop Up Weddings YEG may offer recommendations to assist the client but will under no circumstances by responsible ensuring that any specific activity is permitted at the venue. Reimbursement by Pop Up Weddings YEG will not be made for items due to venue limitations not communicated to Pop Up Weddings YEG by the client within a reasonable time to make modifications.
INDEMNITY BY THE CLIENT

The client is liable for the indemnity and save and hold harmless Pop Up Weddings YEG, its successors and assigns, and each of their respective directors, officers, employees and agents from and against any and all liabilities and costs whatsoever, which may be brought against Pop Up Weddings YEG as a result of any act or omission of the client or agents or persons for whom the client is responsible for at law or against any and all liabilities or costs whatsoever, which may be brought against Pop Up Weddings YEG as a result of any act or omission of the Venue, except to the extent arising from the negligence or wilful misconduct of Pop Up Weddings YEG, its directors, officers, employees or agents.

ADDITIONAL TERMS AND CONDITIONS

Pop Up Weddings YEG acts as a wedding planner for the client by booking various wedding suppliers. Pop Up Weddings YEG accepts no responsibility or liability on behalf of the wedding suppliers themselves. The client releases Pop Up Weddings YEG from all claims and liability relating to said suppliers, booked on behalf of the client.

Pop Up Weddings YEG will abide by all conditions set down by Alberta Liquor Gaming Commission. Pop Up Weddings YEG is NOT licensed to serve or provide alcohol. We do however reserve the right to recommend to 3rd party providers to refuse service of alcohol to any guests displaying signs of intoxication. No outside or homemade alcohol will be permitted in the venues.

All guests over the age of two years must be counted in your final guest count and the final count must not exceed the agreed upon guest count. Children must be supervised by responsible adults at all times.

Pets are not permitted within the venue without consent of the venue and Pop Up Wedding YEG organizers.

No outside food or drink shall be permitted to be brought into the venue for consumption by clients, their family or guests without written consent of the venue and Pop Up Weddings YEG organizers.

Pop Up Weddings YEG accepts no responsibility for damage or loss of merchandise or property of clients, their family or guests during or after an event.

Each couple has a set scheduled ceremony start time, and a designated length of time for the ceremony. Should the client or their guests not be available at the designated time, no additional time shall be assigned or permitted. Guests are only allowed to enter and be seated in the venue within 15 minutes prior to the wedding ceremony and all guests must vacate the premises immediately following the completion of the event.

Bubbles, confetti, flower petals and glitter are prohibited within the Venues and designated outdoor parking areas. A cleaning fee of $250 will be charged upon unauthorized use of these items.

In case of inclement weather, It will be at the discretion of the Pop Up Weddings YEG organizers to make the decision on when and under what circumstances the event will move to an alternate location.

Every effort will be made to maintain the exact appearance of the Venue, however changes, upgrades and improvements may take place between the date of booking and the event.

Photographs, film negatives, digital negatives or prints produced by the photographers within Pop Up Weddings YEG are protected by Federal Copyright Law, and exclusive copyright and ownership belong to Pop Up Weddings YEG’s photographers. Prints and digital files provided to the client may be used for personal use only. Commercial uses of any digital images are prohibited. Pop Up Weddings YEG is not responsible for storing or archiving images after file delivery to client.

The client grants Pop Up Weddings YEG and its suppliers and assigns, the irrevocable and unrestricted right to use and publish photographs of the client, the client’s family and guests or in which the client, client’s family or guests may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client releases Pop Up Weddings YEG, its suppliers and assigns from all claims and liability relating to said photographs.

GENERAL PROVISIONS
